NOTICE OF PRIVACY PRACTICES

OUR LEGAL DUTIES

We are required by law to:

  • Maintain the privacy and security of your protected health information (PHI)
  • Provide you with this Notice of our legal duties and privacy practices
  • Follow the terms of this Notice currently in effect

PHI includes information that identifies you and relates to diagnostic imaging services you receive or payment for those services.

HOW WE MAY USE AND DISCLOSE YOUR HEALTH INFORMATION

For Treatment

We may use and disclose your PHI to provide, coordinate, or manage diagnostic imaging services. Examples include sharing imaging reports and images with your referring provider, hospitals, or other providers involved in your care, and transmitting images and reports through secure electronic systems such as PACS or image-sharing platforms.

For Payment

We may use and disclose your PHI to bill and receive payment for imaging services, including submitting claims to insurance companies and responding to requests for prior authorization or medical necessity.

For Healthcare Operations

We may use and disclose your PHI for healthcare operations, including quality improvement, accreditation, peer review, compliance, audits, risk management, business administration, and legal services.

OTHER PERMITTED USES AND DISCLOSURES

We may use or disclose your PHI as permitted or required by law, including for public health and safety activities, health oversight activities, compliance with court orders or lawful requests, to prevent or lessen a serious threat to health or safety, and for workers’ compensation or similar programs. Certain disclosures may be further limited by Florida law.

SPECIAL PROTECTIONS FOR CERTAIN HEALTH INFORMATION

In limited circumstances, we may receive health information subject to additional federal confidentiality protections, including information related to the diagnosis, treatment, or referral for treatment of a substance use disorder, as defined under 42 C.F.R. Part 2.

Our practice does not provide substance use disorder treatment services. However, such information may be included in imaging orders or clinical histories received from other healthcare providers. When received, this information is protected by stricter confidentiality requirements, may be used or disclosed only as permitted by federal law, and generally may not be used or disclosed in legal proceedings against you without your written consent or a qualifying court order.

USES AND DISCLOSURES THAT REQUIRE YOUR WRITTEN AUTHORIZATION

We will obtain your written authorization before using or disclosing your PHI for marketing purposes (unless permitted by law), sale of PHI, or any use or disclosure not otherwise described in this Notice. You may revoke an authorization in writing at any time, except to the extent we have already relied on it.

YOUR RIGHTS REGARDING YOUR HEALTH INFORMATION

You have the right to inspect and obtain a copy of your PHI, request an amendment, request restrictions on certain uses or disclosures, request confidential communications, receive an accounting of certain disclosures, receive a paper copy of this Notice upon request, and be notified following a breach of unsecured PHI. Your right of access includes imaging reports and, where applicable, copies of diagnostic images, subject to applicable legal requirements, technical limitations, and reasonable fees permitted by law. Requests should be submitted to our Privacy Officer.

COMPLAINTS

If you believe your privacy rights have been violated, you may file a complaint with our Privacy Officer or with the U.S. Department of Health and Human Services, Office for Civil Rights. You will not be retaliated against for filing a complaint.

WEBSITE, ANALYTICS, AND DIGITAL COMMUNICATIONS

Our website may collect limited technical and usage information through cookies, analytics tools, and similar technologies to help improve website performance, security, user experience, and communication effectiveness.
